Failing to revert the official global and local access standards to what they were before commercial interests were able to bling things up, making bright white backgrounds the default, exciting people to buy, and capturing the standards makers, falsely claiming this was universal design, will mean that deaths and damage from sensory overload, often by triggering an epileptic or similar attack, will continue. It is my own personal experience quite recently (in 2022), of getting the anti-torture authorities in Portugal to successfully threaten the University of Coimbra, including its Faculty of Arts, with action unless they conceded showing things on a grey screen. This was after a report on my needs had failed, despite documents of my diagnosis and assessment for visual stress in 2010 being sent twice by me as part of the evidence presented, to recommend a different colour background from bright white. It should be noted in this respect that vulnerability to this type of reaction is primarily linked to neurodivergence, especially in terms of heightened neurosensitivity, not disability and not everyone who is neurosensitive in this respect would necessarily be disabled. But they will be neurodivergent, at least in this way. This highlights the need for specific legislation on neurodivergence, including neurosensitivity, and a comprehensive linked enforcement of rules, regulations on this, with the creation of appropriate standards as well. Many, if not most and almost certainly the vast majority of neurodivergents do not identify as disabled and this is most unlikely to change. Up until now, however, neurodivergents have been forced to identify as disabled, very often, to have any chance at all of getting at least some of their needs at least partially met. Though, even then, very often, in vain. I know from years of involvement, including as a member of the British Standards´ Institution Disability Expert Reference Group (DERG), followed by their Accessibility Committee, that going down the disability route has not proven sufficient. And standards remain worse than when the blinging up, overloading process gathered speed as lessons from Ancient Rome and earlier, all the way through to the Victorian age, were deliberately ignored and suppressed. Of course this must be linked, at a global level, to the United Nations´ (UN) Sustainable Development Goals (SDGs), especially Goal 10: Reducing Inequality within and amongst countries, https://sdgs.un.org/goals/goal10, but the obligation to prevent torture and to hold people to account for it, is a far stronger ground to take effective action on globally over this.
